TrackerWay provides GPS tracking software to help companies locate and track their fleet of vehicles in real time through the web and smartphone applications. To use our services, you must:

    Be at least 18 years old or have the legal authority to enter into this agreement on behalf of a company.

    Register for an account and provide accurate, complete, and up-to-date information.

    Use the services solely for lawful purposes and in compliance with all applicable local, national, and international laws.

    Not attempt to reverse-engineer, decompile, or otherwise interfere with the software’s functionality.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials, including your username and password. You agree to:

    Notify us immediately of any unauthorized access or use of your account.

    Accept responsibility for all activities that occur under your account.

    Ensure that any data uploaded or processed through our platform complies with applicable data protection laws.

4. Membership, Billing, and Renewal

Membership begins upon purchase. Subscriptions do not auto-renew unless you explicitly request it via email or by enabling automatic renewal. We do not store payment information; all payments use secure third-party gateways. Users will be notified 30 days before account expiration. Failure to renew may result in suspension of service.

5. Refund Policy

Users can request a full refund within 30 days of purchase by contacting our support team via the methods listed on our website.

6. Account Suspension and Termination

TrackerWay reserves the right to cancel active memberships without refund if a user intentionally harms, disrupts, or abuses our platform. TrackerWay may also refuse or not renew service for users believed likely to harm our business. Service may be suspended or terminated if a user has two unpaid invoices or fails to renew.

7. Data Hosting and Privacy

TrackerWay is based in the European Union. All user data is processed and stored within the EU, compliant with EU GDPR. We do not sell, share, or distribute user data to third parties. Refer to our Privacy Policy for more details.

Data Deletion and Return

Upon termination or expiration of your subscription (including non-renewal or non-payment), you may request the return of your data (such as GPS tracking logs, vehicle information, and reports) in a machine-readable format within 30 days by contacting [email protected]. TrackerWay will provide the data at no additional cost, provided your account is in good standing.

If your subscription lapses due to non-payment, TrackerWay will follow this notification and deletion process:
– **First reminder**: Sent immediately upon payment due date passing.
– **Second reminder**: Sent 30 days after due date, notifying that your account and all associated data will be deleted within 30 days unless payment is received.
– **Third reminder**: Sent 14 days after due date, confirming account and data deletion within 14 days.
– **Fourth reminder**: Sent 7 days before deletion.
– **Final notice**: Sent 1 day before deletion.

After the final notice, TrackerWay will permanently and securely delete all your account data, including GPS location history, vehicle details, and user information, in accordance with GDPR requirements. No further access or recovery will be possible. TrackerWay bears no liability for data loss following this process.

You remain responsible for backing up your data during the subscription period.

8. Acceptable Use Policy

Users must not use the Service for unlawful, harmful, or abusive conduct, including spamming, hacking, or unauthorized data extraction. TrackerWay may investigate violations and suspend or terminate relevant accounts.

9. Intellectual Property Rights

All software, content, trademarks, and technology on or related to TrackerWay are owned by TrackerWay or its licensors. Users must not reproduce, reverse engineer, or otherwise misuse TrackerWay’s intellectual property.

10. Service Availability & Warranty Disclaimer

TrackerWay strives for service continuity and reliability but does not guarantee that the Service will be available at all times. All services are provided “as is,” and TrackerWay disclaims all implied warranties to the fullest extent permissible by law.

11. Indemnification
